It does not seek unrelated private family transactions. Current and Former Employees “County employee” or “EDSO employee” includes any person employed by El Dorado County or EDSO at the time of a responsive transaction or activity, whether or not the person is currently employed, retired, medically retired, resigned, transferred, terminated, or otherwise separated from County service. This request does not ask the County to create a new appraisal or valuation. 4. For services involving County personnel, please include responsive payroll, timekeeping, assignment, leave, overtime, flex time, compensatory time, and scheduling records. For private providers, this request seeks responsive records in the County’s possession or control; it does not ask the County to obtain a private provider’s unrelated records. 5. Records Maintained by Current or Former Employees or Officials Where a responsive transaction identifies or involves a current or former County employee or elected official, please include existing responsive public business records associated with that person, including emails, text messages, electronic messages, handwritten notes, memoranda, calendars, invoices, estimates, quotes, receipts, payment and reimbursement records, photographs, attachments, message threads, and other writings concerning the transaction. This includes any copy, scan, photograph, screenshot, or other image of a receipt or proof of payment that an involved County employee or official submitted, received, attached to a communication, or otherwise kept in connection with public business concerning a responsive transaction. For former employees or officials, please include responsive records retained, archived, exported, preserved, transferred, or otherwise maintained by the County following the person’s separation from County service. Provider and County or EDSO Relationships For a provider identified in responsive records as providing a good, service, discount, donation, sponsorship, grant, fundraising support, or other benefit, please provide existing records sufficient to identify the relevant County or EDSO business, funding, sponsorship, donation, or program relationship and its timing. This may include relevant contracts, purchase orders, vendor agreements, trials or demonstrations, evaluations, procurement or purchasing records, selection or adoption records, grant or sponsorship records, and material purchasing, contracting, funding, or program decisions involving that provider. This section seeks existing records sufficient to establish the relationship and timing, not a new analysis. 8. Communications Please provide existing emails and other written or electronic communications, including text and multimedia messages, SMS, MMS, RCS, iMessage or equivalent messaging, instant messages, Microsoft Teams posts and chats, direct messages, social media messages, and voicemail, concerning the request, offer, arrangement, facilitation, provision, acceptance, valuation, pricing, discount, payment, reimbursement, return, reporting, or disclosure of a good, service, labor, discount, donation, complimentary item, payment, or other benefit responsive to this request. Please include responsive attachments and message threads, including attached or embedded receipt images and proof of payment records. 9. This request includes statements filed or maintained on paper or electronically, and all pages and materials submitted with or attached to a statement, including schedules, attachments, cover or transmittal letters, explanatory or supplemental letters, enclosures, and related filing correspondence. Please include scanned copies of paper submissions if maintained electronically, as well as paper copies held by the County or filing office. Please also provide existing records identifying the applicable disclosure category or categories for each covered official for each year covered by this request. 11. Other Financial Disclosure Records Please provide responsive Forms 801, 802, and 803; amendments; agency payment or gift disclosure records; and other County or FPPC related financial disclosure records concerning payments, goods, services, travel, tickets, benefits, donations, or other things of value involving a covered official. This includes County maintained records concerning behested payments related to a covered official. 12. Review, Reimbursement, Return, or Reporting Please provide nonprivileged existing records reflecting whether a responsive transaction was reviewed or considered for Form 700 or other financial disclosure, gift limit compliance, reimbursement, payment, return, transfer to County ownership, characterization as a vendor sample, demonstration item, donation, gift, discount, employee service, or personal purchase, conflict of interest review, or compliance with County, EDSO, or Political Reform Act requirements. This request does not ask the County to make a new legal determination concerning any transaction. 13. Devices, Accounts, Telephone Numbers, and Data Migration To locate communications responsive to Section 8, please provide existing records sufficient to identify any mobile device, telephone number, email or messaging account, SIM or eSIM, cloud account, or communications service used by a covered official to conduct or receive those public business communications. This includes County issued, County funded, County managed, and personally owned devices, numbers, accounts, and services. Please include responsive assignment, inventory, service, allowance or reimbursement, activation, deactivation, replacement, number change, transfer, and IT ticket records, as well as County held carrier or billing records concerning the responsive communications. Please also include existing records concerning the disposition of a prior device or account and whether responsive communications or data were transferred, migrated, backed up, archived, exported, synchronized, retained, wiped, deleted, or destroyed. Please provide existing records concerning a replacement device, number, or account, including records showing when it was activated and to whom a replacement business number or account was distributed, to the extent those records help identify, locate, search for, or preserve communications responsive to Section 8. This section also includes existing IT, mobile device management, cloud, email, messaging, carrier, archive, or electronic discovery records concerning the search, preservation, migration, retrieval, or recovery of communications responsive to Section 8. It does not ask the County to create a new technical report. This request does not seek disclosure of an otherwise exempt personal cellular telephone number. The number itself may be redacted while producing responsive records concerning its use for public business and the handling of responsive communications. 14. Deleted, Archived, Backed Up, or Recoverable Communications Please include communications responsive to Section 8, including email, that remain available in deleted item or recoverable item folders, archives, existing backups, exports, data migrations, synchronized or cloud accounts, mobile device management or electronic discovery systems, retained former devices, or another participant’s County maintained records. Please provide existing records showing deletion, wiping, retention, backup, migration, search, restoration, or attempted recovery of communications responsive to Section 8. If the County finds no responsive communications in a particular source, please identify whether that source was searched, unavailable, or no longer retained. This section requests existing or reasonably retrievable records. It does not ask the County to recreate data that no longer exists, obtain purely private communications, or prepare a new forensic analysis. Search Scope and Custodians Please conduct or coordinate a reasonable search across the County custodians and systems reasonably likely to possess responsive records, including as applicable: • EDSO, including command staff and Support Services or the records custodian; • current and former covered officials; • current and former County or EDSO employees and elected officials identified in responsive records; • County maintained records associated with former employees or officials; • EDSO and County Information Technology; • telecommunications and mobile device administration; • email, messaging, archive, backup, and electronic discovery systems reasonably likely to contain responsive communications; • Human Resources and Risk Management; • payroll and timekeeping; • Auditor Controller, Accounts Payable, or other financial record custodians; • purchasing and procurement; • County Administration; and • the filing officer or office responsible for Statements of Economic Interests and related disclosure records. Where an initial search identifies another current or former County employee, elected official, department, or custodian reasonably likely to possess responsive records concerning the same transaction, please include responsive records held by that custodian rather than limiting the search to records centrally maintained by EDSO. For former employees or officials, this request seeks County maintained records from their period of County service, including records retained, transferred, archived, exported, or preserved by the County. It does not ask the County to search a former employee’s current personal device for purely private records. Custodian Search Confirmation Please identify in your response which departments, offices, record systems, accounts, archives, backups, and individual custodians were included in the search. For each covered official, please confirm whether that person was separately asked to search records in their possession, custody, or control, including records on personal accounts or devices to the extent they concern public business. For each current County or EDSO employee identified in responsive records as a provider, recipient, arranger, or other participant in a responsive transaction, please confirm whether that person was asked to search for responsive public business records in their possession, custody, or control, including receipt copies, photographs, scans, screenshots, and related communications. If an identified custodian or source was not searched, please state the reason. If the County declines to provide this search information, please state that. Existing Records Only This request seeks existing records only. It does not ask the County, a covered official, current or former employee, elected official, business, vendor, or private citizen to create a new explanation, recollection, statement, invoice, estimate, valuation, or calculation. For private individuals and businesses, the request is limited to responsive records in the County’s possession or control. It does not ask the County to compel a private person to create or surrender unrelated private records. No Responsive Records or Withheld Records For each numbered category, if the County’s search locates no responsive records, please expressly state that no responsive records were located for that category rather than omitting the category from the response. A statement that records were not located is not equivalent to a statement that responsive records do not exist or were never created. If records previously existed but are no longer retained or accessible, please distinguish that from a search that located no records. Where the County no longer possesses or has access to potentially responsive records associated with a former employee or official, please state that in the response. Please provide any existing applicable retention schedule, Notice or Certificate of Destruction, disposition record, wipe record, IT ticket, or other record documenting the loss or disposition of responsive records. This request does not presume that any particular type of documentation exists. If responsive records are withheld in whole or part, please identify the category withheld and the legal basis asserted. If only part of a record is exempt, please redact the exempt information and provide the reasonably segregable nonexempt portion. Preservation Request Because potentially responsive records may exist in multiple locations and formats, I request that the County preserve potentially responsive records while this request is being processed and while any dispute concerning the County’s response remains pending. This includes responsive emails, messages, chats, direct messages, Teams communications, voicemail, documents, photographs, attachments, archives, backups, migrated or exported data, and retained devices. This is a preservation request. It does not assert that the CPRA itself supersedes otherwise applicable retention laws or policies. To the extent responsive records are independently subject to a litigation hold, pending claim, pending litigation, or other preservation requirement, this request does not alter those separate obligations. Thank you, Leslie Schlag Please be as specific as possible by including date/date ranges and the name of the record if known.
